PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondent police to conduct further investigation in connection with FIR in Crime No.390 of 2020 on the file of the Natham Police Station, Dindigul District and further direct the 2nd respondent to include all the offences committed by the accused as stated in the complaint dated 08.05.2020 and 16.05.2020.

ORDER

This petition has been filed seeking direction for further investigation in Crime No.390 of 2020 on the file of the second respondent police.

2. The learned counsel for the petitioner would submit that in the above facts and circumstances of the case, further investigation to be referred by pointing out the photograph annexures along with the typed set of papers in page Nos.13 and 14 and the nature of injuries suffered by the petitioner in Page Nos.15.

3. The learned Government Advocate (criminal side) appearing for the respondents would submit that the investigation has been completed and the final report has also been filed before the Judicial Magistrate, Natham, on 06.02.2021 itself, but, it has not been taken on file so far.

4. Since the final report has been filed, the order of further investigation may not be proper. The petitioner is to appear before the concerned Court, seeking proper relief. But, since the final report has not been taken on file, there shall be a direction to the Judicial Magistrate, Natham, to process the final report, which has been presented by the second respondent herein as per Rules and may also entertain the petition, if any filed by this petitioner, seeking further investigation.

5. With the above directions, this Criminal Original Petition is disposed of.
