ORDER : The Court made the following order :- The petitioner / Accused who was arrested and remanded to judicial custody on 18.05.2025 for the offence punishable under Sections 5(l), 5(j) (ii) r/w 6 of the Protection of Children from Sexual Offences Act 2012 and Section 351(2) of BNS 2023, in Crime No.08 of 2025 on the file of the respondent police, seeks bail,

The prosecution case is that the petitioner's wife is a Teacher and the victim girl had been attending tuition in her house wherein the petitioner committed aggravated penetrative sexual assault on the victim girl several times by coercion and due to which she became pregnant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks bail.

4. The learned Additional Public Prosecutor submitted that the petitioner has involved in very serious offence and the investigation is still pending. Hence, he strongly objected to the grant of bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the earlier applications were dismissed by this Court and the specific overt act against the petitioner, hence this Court is not inclined to grant bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 20.01.2026 msrm 3/5
