Prayer in CRL A(MD). 329/ 2019 :

To set aside the Judgment dated 09.07.2019 made in Spl.Case No.23/2011 on the file of the Spl. Court for Trial of cases under prevention of corruption Act, Tiruchirappalli and allow the above Criminal Appeal.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of MR.C.JEGANATHAN, Advocate for M/S.VEERA ASSOCIATES for the petitioner and of MR.R.MEENAKSHI SUNDARAM, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed seeking orders to modify the condition imposed by this Court in Crl.M.P.(MD) No.6588 of 2019 in Crl.A.(MD)No.329 of 2019 dated 24.07.2019 directing the petitioner to appear before the trial Court on the first working day of every month at 10.30 a.m. 2.It is seen from the records that this Court, while suspending the sentence of imprisonment, has imposed the above said condition. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.802 of 2022 3.The learned counsel for the petitioner would submit that the petitioner was diagnosed with the blood cancer in the year 2005 and she has been taking treatment and that she is now in an advanced stage. He would further submit that the petitioner is now residing at Chennai and she finds it very difficult to travel all along from Chennai to Trichy to appear before the trial Court in the pursuance of the order of this Court. The petitioner has also produced the medical report issued by the Christian Medical College, Vellore. 4.The learned Additional Public Prosecutor would submit that the petitioner may be directed to appear once in two months. 5.Considering the above facts and circumstances and also taking note of the fact that the petitioner is having advanced stage of blood cancer, this Court is inclined to modify the condition and the petitioner is directed to appear before the trial Court once in two months commencing from February 2022. Accordingly, this criminal miscellaneous petition is allowed.
