Criminal Original Petition filed under Section 482 of the criminal Procedure,to set aside the order passed by Learned Additional District and Sessions Judge No.6, Madurai in Crl.M.P.No.5441 of 2023 dated 20.10.2023 and permit the petitioner to move abroad for work and pass any other order or further orders.
ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. K.Govindarajan Dy.S.G.I For S.Pon Senthil Kumaran, Advocate for the Petitioner and of M/s. SMA.Jinnah For R1, S.Ravi Addl Public Prosecutor For R2, this Court made the following order:
The learned counsel for the respondent would submit that the respondent has moved proper application before the District and Sessions Judge (Sessions Court for exclusive trial of Bomb Blast Cases), Poonamallee, Chennai, seeking permission to visit abroad.
2.In view of the above said development, no clarification is required in this case.
3.The learned Additional Public Prosecutor would submit that direction may be issued to the Special Court, Poonamallee, to consider the objection filed by the petitioner and pass orders on its own merits without influenced by this order. Such a right is always available to the petitioner to make appropriate objection before the concerned Court itself.
4.With the above said observations, this criminal miscellaneous petition stands disposed of.
