For Respondent : Mr.R.Srinivasan, Government Advocate (Criminal Side) PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.851 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.7, who was arrested and remanded to judicial custody on 01.12.2020 for the offences punishable under Sections 366 of IPC @ 364(A), 397 IPC, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that the petitioner along with A1 to A5 said to have kidnapped the victim for ransom, that A-6 was informed by the prime accused persons to collect the amount of ransom from the family members of the victim and that petitioner also accompanied with A-6, at the time of collecting amount. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 01.12.2020.

CRL OP(MD). No.349 of 2021 4.The learned Government Advocate (Criminal side) for the respondent would submit that the de-facto complainant is working in New Vision Land Promoters and that the petitioner along with A1 to A5 had kidnapped the victim for ransom and voluntarily caused hurt and committed robbery. He would further submit that the present petitioner also accompanied with the co-accused and committed robbery and that the investigation is still pending. 5.Considering the nature and seriousness of the offences alleged to have committed and also the facts the facts that the petitioner is in judicial custody from 01.12.2020 and that the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
6.In the result, the Criminal Original petition stands dismissed.
