For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.Not known of 2020 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences under sections 420, 465, 470 and 120(b) of I.P.C., in Crime No.2 of 2020 on the file of the respondent police, seek anticipatory bail.

3. The defacto complainant in this case is a temple. It appears that the family of the accused has been in long possession of the property. On the strength of their long possession, the accused had created documents among themselves. This Court made it clear that unless the offending transactions are cancelled, this Court will not https://hcservices.ecourts.gov.in/hcservices/

consider the petition for anticipatory bail on merits. The case was adjourned to enable the learned counsel for the petitioners to get instructions from the petitioners.

4. Today when the matter was taken up for hearing, the learned counsel appearing for the petitioners submitted that all the offending transactions will be totally nullified. It appears that the settlee is presently at Australia. It appears that the process of undoing the mischief may take about three months.

4. Recording the petitioners undertaking, I am incident to grant anticipatory bail to the petitioners herein. The respondent is called upon not to file any final report. After the offending transactions are totally undone, the same may be intimated to the defacto complainant and thereafter, the respondent shall file report dropping further action in the matter.

5. With this direction, this criminal original petition is disposed of.
