To allow this appeal and set-aside the Judgement and Decree dated 05.09.2017 passed in M.C.O.P.No.103 of 2016 on the file of the Motor Accident Claims Tribunal, Chief Judicial Magistrate Court, Nagercoil and pass such other or further orders as this Hon'ble court may deem fit and proper in the circumstances of this case and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.S.MATHIALAGAN, Advocate for the petitioner,the court made the following order:- This petition is filed to condone the delay of 79 days in filing the Civil Miscellaneous Appeal in CMA SR.No.15178 of 2018 https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned counsel appearing for the petitioner.

3. This Court is satisfied with the reasons stated in the affidavit filed in support of the petition to condone the delay of 79 days in filing the Civil Miscellaneous Appeal. Since the delay is inordinate, the delay is condoned on condition that the petitioner / appellant shall pay a sum of Rs.500/- (Rupees Five Hundred only) to the District Legal Services Authority on or before 08.02.2019.
