Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the Respondents 1 to 3 to remove the encroachments made by the Respondents 4 to 8 in S.No.89/2, 90, 91 and 96/6 situated in Karaikudi Town and Kalanivasal Village, Karaikudi Taluk, Sivagangai District by considering the representation given by the Petitioner dated 15/10/2025.

ORDER

Heard the learned counsel for the petitioner and the learned Additional Government Pleader for R1 & R2 and Mr.D.Venkatesh, learned standing counsel for Karaikudi Municipal Corporation.

2. The petitioner is a resident of Karaikudi. He alleges that in the petition mentioned water channels, there are encroachments. 2/4

3. Since they fall within the corporation limits, it is the commissioner of karaikudi municipal corporation who has to take action. We direct the Tahsildar, Karaikudi to conduct survey. The survey results will be duly communicated to the third respondent. Before conducting survey, notices will be issued to all the stake holders including the encroachers as well as the private respondents herein. If the survey results indicate that there are encroachments, the third respondent has to take action as per law to have the encroachment removed. The entire exercise will be completed within a period of four months from the date of receipt of a copy of this order.
