PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records pertaining to the impugned letter in Ref.No.SCN/1053014702/25 dated 23.12.2025 on the file of 1st respondent to quash the same as unconstitutional and consequently direct the 1st respondent to re-issue Passport to the petitioner by scrutinizing petitioner's application File No.MD1076058792025 dated 10.12.2025 in accordance with law, within time stipulated by this Court. ORDER

The presnt writ petition has been filed seeking to quash the communication of the first respondent wherein the petitioner has been called upon to submit his explanation for the adverse report received from the police.

2. According to the learned Government Advocate(crl.side) appearing for the second respondent, the petitioner has been implicated in a criminal case in Cr.No.36 of 2022 on the file of second respondent which has culminated in filing of a charge sheet in C.C.No.232 of 2022 on the file of the Additional Mahila Court, Ramanathapuram.

3. In view of the above said facts, the petitioner is directed to approach the concerned trial Court seeking permission of the Court to go abroad. In case, if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the orders to be passed by the trial Court, the first respondent is directed to proceed in accordance with law. 2/4
