to prefer this appeal before the Hon'ble Court for enhancement of compensation as against the Judgment and Decree in M.C.O.P.No.49 of 2014 on the file of Special Sub Judge for M.C.O.P. Cases, Madurai, dated 28.09.2015 ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. K. KUMARAVEL, Advocate for the petitioner and of MR.D.SIVARAMAN, Advocate for R2, the court made the following order:- This petition has been filed to condone the delay of 345 days in filing the above civil miscellaneous appeal in C.M.A.(MD) No.SR4705 of 2017.

2. When the matter came up for hearing today, the learned Counsel appearing for the 2nd respondent would submit that the 2nd respondent is not having any serious objections in condoning the delay, on condition that the petitioner/ appellant shall not claim interest for the delayed period in the event of enhancement by this Court, which is also agreed by the learned Counsel appearing for the petitioner.

3. In such a view of the matter, the delay is condoned and this petition is ordered on condition that the petitioner shall pay a cost of Rs.500/- (Rupees Five Hundred only) to the Chief Justice Relief Fund, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without any further reference to this Court.
