ORDER : The Court Made the following order :- The petitioner who is the sole accused in Crime No.99 of 2015, apprehends arrest at the hands of the respondent police for an alleged offence punishable under Sections 17 of TNK (RT) Order 1974 r/w. 7(1)(a) (ii) Essential Commodities Act 1955, on the file of the respondent police, seeks anticipatory bail.

2. According to the prosecution the accused has illegally transported 520 Litres of Kerosene of Public Distribution System.

3. The learned counsel for the petitioner submitted that the petitioner is the driver of the Tata Sumo bearing Regn. No.TN 02 D 5415 and he has been falsely implicated in this case.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner is owner-cum-Driver of the Tata Sumo vehicle and he had knowledge about the transportation of the Kerosene and it is further submitted that the petitioner has no bad antecedents.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate-I, Nagercoil, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent Police daily at 10.00 am until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.
