Prayer in Crl.OP(MD)No.15239 of 2019 Criminal Original Petition is filed under section 482 of Criminal Procedure Code, praying this Hon'ble to direct the 2nd respondent to file a final report in Cr.No.36/2019 and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

O R D E R

This Contempt Petition has been filed to punish the respondent for violation of order passed by this Court in Crl.O.P.(MD).No.15239 of 2019 dated 24.10.2019.

2.The contemnor/Inspector of Police, Thirumayam Police Station, is present before this Court and he has also filed a counter. 3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondent would submit that the investigation in Crime No.36 of 2019 was completed on 31.10.2019 and the final report was filed before the learned Judicial Magistrate, Thirumayam. When Crl.OP(MD)No.1523 of 2019 was came up for hearing before this Court on 24.10.2019, due to inadvertence, it was wrongly stated before this Court that the respondent police completed the investigation and filed final report before the learned Judicial Magistrate, Thirumayam on 25.09.2019 and https://hcservices.ecourts.gov.in/hcservices/ 1/2

CONT. P.(MD).No.34 of 2020 it was yet to be taken cognizance. Based on the above submission, this Court has closed the Criminal Original Petition. 4.The facts remains that the final report has been filed on 31.10.2019 and the same was taken on file in P.R.C.No.13/2019 on 20.12.2019. Inadvertently, wrong information has been given before this Court on 24.10.2019. However, the order of this Court has been duly complied with. The respondent, who present before this Court has expressed his remorse and apologised for giving wrong information. The apology of the respondent police is accepted by this Court.
