(R3 is suo motu impleaded by this Court vide order dated 10.01.2022) Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents to grant permission and necessary protection to conduct Pongal Festival and its allied events such as sport events for the children, Anna Dhanam, Temple Pooja, Cultural events ect., at Kaya Vembupathi Narayanaswami Kovil in Kayavembu Pathi, Rasthakadu Variyoor Post, Kanyakumari District scheduled to be held on 14.01.2022 and 15.01.2022 based on his representation in person dated 23.12.2021.

ORDER

The petitioner wants this Court to direct the respondents to grant permission to hold the petition mentioned event.

2. There does not appear to be any communal angle. The third respondent is therefore directed to give permission to the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.328 of 2022 petitioner to hold the petition mentioned event. It is open to the third respondent to incorporate appropriate conditions to ensure the smooth conduct of the event. The petitioner through his counsel gives an undertaking that the organizers of the event will adhere to the police directives. The third respondent while issuing the proceedings permitting the holding of the event shall stipulate appropriate conditions for adhering to Covid-19 protocol. I make it clear that the order has been passed in this writ petition based on the position obtaining today. It is of-course open to the third respondent to take a call, if any subsequent lockdown restriction is imposed by the Government.

3. Recording the said undertaking, this Writ Petition is allowed. No costs.
