PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to direct the 1st respondent to instruct the 2nd respondent not to harass the petitioner under the guise of enquiry without due process of law. This Criminal Original Petition is filed to direct the 1st Respondent to instruct the 2nd Respondent not to harass the Petitioner under the guise of enquiry without due process of law.

2.The learned Counsel for the Petitioner submits that there had been civil suits pending between the Petitioner and the third Respondent. While so, the third Respondent had approached the second Respondent and had given a complaint against the Petitioner.

3.The learned Additional Public Prosecutor, on instructions, submits that the third Respondent had approached the learned Judicial Magistrate, Karur, under Section 156(3) Cr.P.C. After the directions were issued by the learned Judicial Magistrate, Karur, the second Respondent in obedience of the said directions had conducted an enquiry. Since it was civil dispute, the enquiry report will be furnished before the learned Judicial Magistrate, Karur within one month.

4.As per the circular issued by the Additional Director General of Police, Chennai in C.No.18/ADGP/L & O/Camp/2024 dated 09.01.2024, the Police Officials are not expected to involve themselves in civil disputes. Hence, the Respondents 1 and 2 are directed not to harass the Petitioner and act as per the circular issued by the Additional Director General of Police, Chennai in C.No.18/ADGP/L & O/Camp/2024 dated 09.01.2024. Accordingly, this Criminal Original Petition is disposed of.
