Respondents (R4 impleaded as per the order of this Court, dated 09.03.2012 in M.P.(MD)No.1 of 2012) PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the third respondent to handover the lorry bearing Regn.No.TN-72-Y-1288 and Hero Honda Motorcycle bearing Regn.No.TN-69-X-3279 and Nokia Mobile phone with SIM card bearing No.99650 22688 to the petitioner and further to direct the third respondent to pay Rs.1,00,000/- as compensation and consequently to direct the first and second respondent to initiate disciplinary proceedings against the third respondent.

O R D E R

When the matter is taken up for hearing, a report has been placed by the learned Additional Government Pleader appearing for the respondents 1 to 3, dated 19.10.2010.

2.As seen from the report issued by the Superintendent of Police, Tuticorin District, in-charge of Tirunelveli District, the vehicles, which are the subject matter of this Writ Petition, have already been handed over to the petitioner pursuant to the interim direction of this Court on 16.09.2010 in M.P.(MD)No.1 of 2010 in W.P.(MD)No.7498 of 2010.

3.Since the vehicles have already been handed over to the petitioner, nothing survives for further adjudication in this Writ Petition. Accordingly, this Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petitions are closed.

This Writ Petition comin again on 15.02.2022 for orders under the caption 'for clarification'and upon hearing the arguments of Thiru.S.S.Thesigan, Advocate for the Petitioner and of Thiru.D.Sasikumar, AGP for R1 to R3, this Court made the following order:

Earlier by order dated 07.02.2022, this writ petition was dismissed as infructuous. At the request of the learned Counsel for the petitioner, the matter is posted today under the caption 'for Clarification'.

2.Today, learned Counsel for the petitioner submits that now he does not seek for any clarification of the order dated 07.02.2022. The said statement is recorded.

3.Accordingly, no further clarification is required in the order dated 07.02.2022.
