Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 in Crime No.235 of 2014 on the file of the respondent police apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 419, 420, 465, 468, 471 and 120(b) IPC and hence, seeks anticipatory bail.
2.According to the defacto complainant, the first accused/petitioner herein without any right over the property in dispute sold the same to the accused Nos.2 and 3. 3.The learned counsel for the petitioner has submitted that the defacto complainant had sold the property in dispute to the petitioner by a registered sale deed dated 30.05.2011 for a sale consideration of Rs.75,000/- and only thereafter, the petitioner sold the property to the accused No.2 by a registered sale deed dated 26.03.2012. He would further submit that the due to increase of the land value, a false complaint was given alleging that the petitioner without any right sold the property. He would also submit that the petitioner is an innocent and he has been falsely implicated in this https://hcservices.ecourts.gov.in/hcservices/ case and the accused Nos.2 and 3 were already granted anticipatory bail. The learned counsel also produced the copies of sale deeds.
4.Heard the learned Government Advocate(Crl.side) and perused the materials available on record.
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Tirunelveli on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. for a period of two weeks and thereafter as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
