Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is the arrayed as first accused, apprehends arrests for the alleged offence punishable under Section 379 I.P.C and 21(4)(1A) of M.M.Act in Cr.No.269 of 2015 on the file of the the respondent Police, seeks anticipatory bail.
2.The case of the prosecution is that on 11.06.2015, the Police Officials went to the normal rounds in the occurrence place. At that time, the petitioner was found in possession of 1/2 unit of river sand illegally.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence. 4.The learned Government Advocate (Crl.Side) seriously opposed this anticipatory bail application stating that the petitioner is having three previous cases of similar nature.
5. Considering the allegations against the petitioner, this Court is of the view that the petitioner is not entitled for anticipatory bail.
