Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle the belated payment interest at the rate of 6% p.a. on the delayed payment of Retirement Benefits such as Provident Fund Rs.16,68,727/-, Gratuity Rs.10,69,200/- and Leave Salary Rs.5,73,659/- from the date of retirement on 30.11.2021 till the date of settlement on 29.03.2023. 1/4

O R D E R

The present Writ Petition has been filed by the wife of a deceased employee of the respondent Transport Corporation seeking a Mandamus for payment of interest for the belated disbursement of pensionary benefits.

2. According to the learned counsel appearing for the petitioner, the petitioner's husband had passed away on 18.07.2023 and his terminal benefits were released only on 29.03.2023. Therefore, the petitioner has sent a representation on 13.12.2024 to the respondents seeking interest for the belated disbursement. Since there is no response, the present writ petition has been filed.

3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents. 2/4

Considering the above said facts, the respondents herein are directed to pay the interest at the rate of 6% per annum for the belated disbursement of terminal benefits from the due date till the date of disbursement, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above said observations, this Writ Petition stands disposed of. There shall be no order as to costs.
