O R D E R

The petitioner has been in custody since 22.12.2014, having been arrested in connection with the case registered in Crime No.781 of 2014 on the file of the respondent police for the alleged offences punishable under Sections 406 and 420 IPC.

2. The petitioner has been granted bail under orders in Cr.M.P.No.9997 of 2014. In doing so, the learned Judicial Magistrate No.III, Trichirappalli, has imposed condition that the petitioner deposits a sum of Rs.15 lakhs to the credit of Crime No. 781 of 2014 or in the alternative produce security by way of immovable property in such sum. He has also been required to produce two sureties in sums of Rs.10 lakhs.

3.The learned counsel for the petitioner submits that the conditions imposed are onerous and as a result thereof the petitioner is still languishing in custody despite the order of bail dated 05.01.2015. 4.The learned counsel for the petitioner undertakes that the petitioner would deposit a sum of Rs.3,00,000/-(Rupees three lakhs ony) to the credit of Crime No.781 of 2014 within a period of two months from the date of his release.

5.In modification of conditional order passed by the learned Judicial Magistrate No.III, Trichirappalli, in Cr.M.P.No.9997 of 2014, the petitioner shall now be required to execute a bond in a sum of RS.10,000/-(Rupees ten thousand only) and also produce two sureties for such sum to the satisfaction of the concerned Magistrate. The undertaking made on his behalf that the petitioner would deposit a sum of Rs.3,00,000/-(Rupees three lakhs only) to the credit of Crime NO. 781 of 2014 within a period of two months from the date of his release is recorded. Accordingly, this petition is ordered.
