Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners apprehend arrest at the hands of the respondent police for the offences punishable under Sections 147, 148, 294(b), 323, 324 & 506(ii) IPC in Crime No.40 of 2018, seek anticipatory bail.

2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. side) appearing for the respondent.

3.The defacto complainant is 60 years old lady, namely Arasi. It appears that the petitioners herein were upset by the moves taken by the said defacto complainant for giving marriage of her grand daughter in favour of nephew of the first accused. During the quarrel, the five accused surrounded the de facto complainant and assaulted her. Accused No.3, namely Tamil Selvi had hit on the head of the de facto complainant and she is still taking treatment in the hospital.

Petition so far as the second petitioner / A3, namely Tamil Selvi is concerned.

5.However, taking note of the allegations against the other accused, this Court is inclined to grant anticipatory bail to the first, third and fourth petitioners subject to the following conditions. Accordingly, the first, third and fourth petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Paramakudi and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required for interrogation. The first, third and fourth petitioners shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The first, third and fourth petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail shall stand dismissed.
