RESPONDENT/RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition imposed in Crl.M.P.(MD)No.2504/2020 in Crl.R.C. (MD).No.782/2019, dated 12.03.2020 instead of appearing before the Judicial Magistrate No.II, Kuzhithurai, Kanyakumari District, petitioner may be permitted to appear before the Judicial Magistrate, Vilathikulam, Tuticorin District on the first working day of every month at 10.30a.m.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.MAYILVAHANARAJENDRAN.C, Advocate for the petitioner and of Mrs.S.BHARATHI, Government Advocate (Crl.side) on behalf of the Respondent, the Court made the following order:- This petition has been filed to modify the condition imposed by this Court in Crl.M.P.(MD)No.2504 of 2020 in Crl.R.C.(MD)No.782 of 2019 dated 12.03.2020.

2.On the side of the petitioner, it is stated that the petitioner is complying the condition. However, due to the mistake of the learned counsel for the petitioner, this Court has ordered the petitioner to sign before the learned Judicial Magistrate No.II, Kuzhithurai, Kanyakumari District whereas the jurisdiction lies only with the learned Judicial Magistrate, Vilathikulam and prayed the condition to be modified to that effect.

3.In view of the above, this Criminal Miscellaneous Petition is allowed and the petitioner is directed to appear before the Judicial Magistrate, Vilathikulam on the first working day of every month at 10.30 a.m.
