ORDER

Seeking to direct the 3rd respondent to conclude the enquiry pertaining to CSR No.510 of 2025 on the file of the 3rd respondent based on the petitioner's complaint dated 11.11.2025, this criminal original petition is filed.

2. The petitioner has lodged a complaint as against one Asokan and others with respect to a dispute relating to Cheran Education Trust. In that regard, already a First Information report has been registered in Crime No.183 of 2025 on 20.07.2025. In the meanwhile, the accused in Crime No.183 of 2025 are causing continuous threats to the witnesses concerned. In this regard, another complaint was lodged by the petitioner as against the said Ashokan and others before the 3rd respondent Police Station, for which CSR bearing No.510 of 2025 has been issued on 11.11.2025 and the matter is pending before the 2nd 2/6

respondent. While so, this criminal original petition is filed by the petitioner seeking to direct the 3rd respondent to conclude the enquiry pertaining to the said CSR.

3. When the matter came up for hearing, the learned counsel for the petitioner sought for directing the 3rd respondent police to conclude the inquiry within a stipulated period of time.

4. However, the learned counsel for the proposed accused Mr.Sathish Babu, submitted that it is all a dispute between the Trust wherein the said Advocate, namely Asokan has unnecessarily roped ii.

Per contra, the learned Government Advocate (Crl.Side) submitted that already a First Information Report in Crime No.183 of 2025 came to be registered as against the said Asokan and others and the counter case has also been registered as against this petitioner in Crime No.182 of 2025. Now, this is the 2nd complaint which is received from the petitioner and enquiry is pending.

6. Heard the learned counsels on either side and carefully perused the materials available on record.

To allay the petitioner's apprehensions and to ensure fairness, the 2nd respondent police is directed to issue written summons/ notice under Section 62 Cr.P.C/64 BNSS, specifying the date and time to the petitioner and to the proposed accused to appear before the 2nd respondent Police Station for enquiry and enquiry is directed to be concluded within a period of two (2) weeks from the date of receipt of copy of this order.

8. With the above directions, this Criminal Original Petition stands disposed of.
