PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari calling for the records pertaining to the impugned order of the 3rd respondent vide his proceedings in Tha.Va.2/2024-2025 (Na.Ka.No.1824/2024 Sapa) dated 22.08.2025 and quash the same as illegal. 1/4

ORDER

The present writ petition has been filed challenging the surcharge order passed under Section 87 of Tamil Nadu Co-operative Societies Act on 22.08.2025 by the third respondent herein.

2. Considering the fact that the petitioner is having effective alternative statutory appeal remedy under the Tamil Nadu Co-operative Societies Act, this writ petition is disposed of, preserving the right of the writ petitioner to file a statutory appeal before the Co-operative Tribunal.

3. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed.

4. The Registry is directed to return the original order. If the appeal is preferred on or before 28.02.2026, the same shall be entertained without any reference to the period of limitation.
