For Respondent : Mr.A.Thiruvadi Kumar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.12 of 2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police, for the offence punishable under sections 8(C) r/w 20(b)(ii)(c), 29(1) & 25 of NDPS Act, in Crime No.12 of 2020, on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioner along with other accused were in illegal possession of 144 kgs of Ganja for sale.
3.The learned counsel appearing for the petitioner submits that this is the third petition filed by the petitioner for anticipatory bail. The earlier petitions filed by the petitioner in Crl.O.P(MD). Nos.2957 and 16263 of 2021 were dismissed by this Court on 30.04.2021 and 28.10.2021. He further submits that the petitioner is ready to abide by any conditions imposed on him by this Court. CRL OP(MD). No.796 of 2022 4.The learned Additional Public Prosecutor submits that this is the third bail petition. Earlier petitions filed by the petitioner for anticipatory bail were dismissed by this Court. It is further observed that though there was no recovery from the petitioner, the entire contraband of 144 kgs of ganja has been recovered from the other accused and based on the confession statement of the coaccused this petitioner is added as accused. In view of the provisions under Section 37 of NDPS Act, the earlier bail application was dismissed and as of now, there is no change in circumstances.
5.Since there is no change in circumstances, after the dismissal of earlier petitions, this Court is not inclined to entertain this application for anticipatory bail. 6.Accordingly, the Criminal Original Petition is dismissed. sd/- 27/01/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
