PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus call for the records relating to the Impugned Notice dated 01.01.2026 issued by the 1st respondent and quash the same and further direct the 1st respondent to issue passport forthwith to the petitioner.

ORDER
The present writ petition has been filed seeking to quash the communication issued by the first respondent calling upon the writ petitioner to offer his explanation with regard to the criminal case pending as against the writ petitioner.
2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.99 of 2024 on the file of the second respondent for the alleged offences under Sections 279 and 337 of IPC and subsequently altered into Sections 279 and 338 of IPC. So far investigation has not been completed.
3. This Court in a judgment reported in 2014 (8) MLJ 61 has held that mere pendency of FIR is not a legal impediment for issuance of the passport.
4. Considering the above said facts, the first respondent is directed to consider the application of the writ petitioner and pass orders within a period of two weeks from the date of receipt of a copy of this order. 2/4
