Prayer: Writ Petition filed under Article 226 of the Constitution of India praying this Court to issue a Writ of Mandamus, directing the respondents 1 and 2 to act on the recommendation in Proc.Na.Ka. 2337/E2/2020 dated 04.05.2022 of the 3rd respondent and rectify the anomaly by re-fixing the petitioner's basic pay at Rs.51910+9000 = Rs.60910/- with monetary effect from 01.09.2008 and consequentially to revise her pension as well, within a stipulated date which may be fixed by this Court.

This writ petition has been filed for a writ of Mandamus to direct the respondents 1 and 2 to act on the recommendation in Proc.Na.Ka. 2337/E2/2020 dated 04.05.2022 of the 3rd respondent and rectify the anomaly by re-fixing the petitioner's basic pay at Rs.51910+9000 = Rs.60910/- with monetary effect from 01.09.2008 and consequentially to revise her pension.

2.The short issue involved in this writ petition is that the claim of the petitioner for rectification of an anomaly, which had been forwarded by the third respondent is still pending consideration before the second respondent and the same has not been disposed of inspite of more than 3 years from the date of the said recommendation. 3.Counter affidavit has been filed on behalf of the respondents 1 and 2.

4.A reading of the counter affidavit particularly Paragraph Nos.13 and 14 indicate that the claim of the petitioner is still alive and the orders are yet to be passed.

5.In such view of the matter, there shall be a direction to the second respondent to pass appropriate orders on the recommendation made by the third respondent dated 04.05.2022 within a period of 12 weeks from the date of receipt of a copy of this order. 3/5
