JUDGMENT

This second appeal has been filed against the judgment and decree passed in A.S.No.104 of 2005 dated 22.12.2005 on the file of the Additional Subordinate Judge, Kumbakonam, reversing the judgment and decree passed in O.S.No.59 of 2002 dated 29.06.2004 on the file of the 1st Additional District Munsif, Kumbakonam.

2. When the matter came up for hearing, the learned counsel for the appellant submitted that the prayer sought for by the appellant become infructuous. He has also made an endorsement to that effect.

3. Recording the same, this second appeal is dismissed as infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
