O R D E R

The present Writ Petition has been filed challenging the order passed by the respondent herein under which the gun licence of the writ petitioner was cancelled.

2.According to the learned Counsel for the petitioner, the said license has been cancelled without issuing a show cause notice or conducting an enquiry and hence, the orders suffers from violation of principles of natural justice.

3.Per contra, the learned Counsel for the respondent contends that the petitioner had threatened some persons using the gun and hence, a criminal complaint was also registered as against the writ petitioner in Crime No.659 of 2012 on the file of Perumalpuram. Only based upon the said facts, the respondents cancelled the gun license of the writ petitioner.

4.Admittedly, the gun license of the writ petitioner has been cancelled without issuing the notice or conducting an enquiry. Hence, the order suffers from violation of principles of natural justice. W.P.(MD).No.10410 of 2012 respondent herein is set aside and the matter is remitted back to the file of the respondent for fresh consideration. The respondent shall issue notice and after affording personal hearing to the writ petitioner, shall proceed to pass orders. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above said observation, the Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
