ORDER

Mrs.J.Padmavathi Devi, learned Special Government Pleader takes notice for the respondents 1 to 3 and Mr.G.Prabhu Rajadurai, 1/3

learned counsel takes notice for the fourth respondent.

2. By consent, the writ petition is taken up for disposal at the admission stage itself.

This writ petition has been filed seeking for issuance of a Writ of of Certiorarified Mandamus calling for the records pertaining to the rejection decision taken in the Peace Committee Meeting held by the 1st and 2nd respondents on 06.01.2020 and quash the same as illegal and direct the 1st and 2nd respondents to grant permission to conduct the temple festival with Turmeric Water Abishegam followed by offering Pongal, Theechatti and Milk Kudam for the goddess of Sri Kaliamman Temple at Panikkanenthal Village, Kariyapatti Taluk, Virudhunagar District, to be scheduled on 10.01.2020 and 11.01.2020.

4. There are two community people in the petitioner's village. The petitioner belongs to opposite community. Now the dispute is with regard to conduct of festival at Sri Kaliamman Temple in the village. Earlier on 06.01.2020, there was a peace committee meeting in the presence of the Revenue Divisional Officer and the Deputy Superintendent of Police, Virudhunagar District, before whom it was decided that as there was no cordial relationship and congenial atmosphere in the village between two communities permission to conduct the temple festival was refused to the villagers.

Aggrieved by the same, one group of villagers of Panikkanenthal Village had filed W.P(MD)No.316 of 2020 and in which, an order was passed on 07.01.2020 allowing them to conduct the festival with the help of the police. Today, the petitioner belonging to the other group, has come up with this writ petition seeking permission to conduct the festival of the said Kaliamman Temple.

6. Admittedly, both the communities were jointly celebrating the said temple festival all these years. It is from the last year, there has been a division in the groups leading to peace committee meeting etc. As already the other group was permitted to conduct festival, this petitioner is also permitted to conduct festival only for one day ie., on 10.01.2020 by doing Turmeric Water Abishegam followed by offering pongal, Theechatti and Milk Kudam for the said Sri Kaliamman.

The petitioner is permitted to conduct the festival as per the prayer sought for in the writ petition commencing the pooja from 08.00 a.m., and complete it before 01.00 p.m on 10.01.2010 only and the third respondent is directed to give adequate police protection for the performance of the same and ensure maintenance of peace in and around the temple.

With the above directions, the Writ Petition is disposed of. No Costs.
