Respondents PRAYER :- This Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order issued by the 2nd respondent dated 05.01.2026 and quash the same as illegal and consequentially direct the 2nd respondent to grant permission of 1st Annual Music function conducting by the Sound & Light Association, Batlagundu on 10.01.2026 & 11.01.2026 and to provide adequate police protection at Thathapatti village, Batlagundu Taluk, Dindigul District. ORDER
This writ petition is filed for Writ of Certiorarified Mandamus challenging the impugned order issued by the 2nd respondent dated 05.01.2026 and consequently, direct the 2nd respondent to grant permission of 1st Annual Music function conducting by the Sound & Light Association, Batlagundu on 10.01.2026 & 11.01.2026 and to provide adequate police protection at Thathapatti village, Batlagundu Taluk, Dindigul District.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

The learned Government Advocate (Crl.Side) on instructions would submit that the petitioner has invited the Sound and Light Association and proposes to conduct a programme to ascertain who is playing sound with appropriate music. The respondents, however, submitted that such an exercise would amount to exploitation of sound and would adversely affect the local residents. 2/5
4. The learned counsel for the petitioner would rely upon the judgment passed by this Court in W.P.Crl.(MD)No.2428 of 2025.
5. This Court vide order dated 05.12.2025, in W.P.Crl.(MD)No. 2428 of 2025, the petitioner was directed not to use any cone speaker or any other speaker beyond the permissible decibel level.
6. In view of the same, the impugned order is quashed. The petitioner is directed to submit a fresh representation to the respondents indicating the place, date and time. On such representation, the respondents shall grant permission by imposing condition, especially with the condition of decibel capacity.
