The present Writ Petition has been filed by a Driver/Security Guard working in the third respondent Organization, challenging the order dated 09.11.2024, wherein he has been relieved from his services.
2. The petitioner herein was initially appointed on 10.10.2019 on contract basis for a period of one year as Driver/Security Guard. The services were extended every year. However, under the impugned order dated 09.11.2024, he was relieved from his services with effect from 11.11.2024 on completion of the contract period. The said order is under challenge in the present writ petition.

3. According to the learned counsel appearing for the petitioner, when his services were extended from the year 2019 to 2024, instead of extending the services for one more year, he had been relieved from duty without assigning any reason whatsoever.

Per contra, the learned Additional Government Pleader appearing for the respondents 1 to 3 had contended that a paper publication was issued on 20.12.2024 calling for application to the post of Driver/Security Guard to fill up 30 vacancies and they have received 31 applications and they are yet to finalise the list of candidates. It is also submitted that the petitioner has not applied for the said post.

Considering the fact that the petitioner is on contractual employment and he has been relieved from service on completion of the contractual period, this Court is of the considered opinion that the relieving order cannot be challenged by the writ petitioner. That apart, the petitioner has not chosen to challenge the paper publication for direct recruitment. In such circumstances, there are no merits in this writ petition. 3/5
