ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to issue patta based on the petitioner's representations dated 15.04.2025 and 09.12.2025, within a stipulated time to be fixed by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that the petitioner is in peaceful possession/occupant of the subject property based on the Will executed by his grandfather on 10.10.1992 and is entitled to issuance of patta in accordance with law. The petitioner has submitted detailed representations dated 15.04.2025 and 09.12.2025 to the third respondent, seeking issuance of patta, along with all relevant documents. Despite receipt of the said representations, the third respondent has failed to consider and dispose of the same, which is arbitrary, unreasonable, and violative of the principles of natural
justice. Hence, the petitioner has approached this Court by filing the present Writ Petition.
4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representations will be considered on merits and in accordance with law, within a time frame to be fixed by this Court.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representations dated 15.04.2025 and 09.12.2025, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, and any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
