Respondents/Respondents PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records and quash the impugned charge sheet in C.C.No.1621 of 2023 of Crime No.98 / 2011 on the file of the learned Judicial Magistrate No.I, Madurai insofar as this petitioners/accused Nos.1,2,4,7 to 9 are concerned and pass such other orders.

ORDER

The accused persons have filed the present petition seeking to quash the charge sheet in C.C.No.1621 of 2023 of Crime No.98 of 2011 on the file of the learned Judicial Magistrate No.I, Madurai F.I.R, wherein the petitioners are alleged to have charged for the offences punishable under Sections 120(b), 406, 419, 468, 471, 420 of IPC @ Sections 120(B), 491, 423, 465, 468, 471, 420 of IPC.

2. Pending trial, the parties have entered into a compromise, wherein, the defacto complainant has agreed for quashing of the charge sheet.

3. The defacto complainant is present in-person before this Court and he submits that he had agreed for quashing of charge sheet as against the petitioner.

4. A perusal of the charge sheet reveals that the joint family property was sold by the first accused in favour of the second accused, in respect of which a complaint has been lodged by the second respondent. It is now brought to the notice of this Court that the said sale deed has been cancelled by the District Registrar, Madurai, and the property has been restored as joint family property. The second respondent has agreed to the quashing of the charge sheet. It is also 2/4

brought to the notice of this Court that, whereabouts of the sixth accused are not known, and he has been declared a proclaimed offender.

5. In view of the compromise entered into between the parties, and in light of the fact that the property has been restored as joint family property by cancellation of the sale deed, no purpose would be served in continuing the criminal proceedings against the petitioners herein.

6. In view of the above, the charge sheet in C.C. No. 1621 of 2023 on the file of the Judicial Magistrate No. I, Madurai, stands quashed not only as against the petitioners herein but also as against the other accused persons in the said case. Accordingly, this Criminal Original Petition stands allowed. The joint compromise memo shall form part and parcel of the order. 26.03.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No gvn 3/4
