O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to cancel Joint Patta No.984 and consequently restore the earlier position of Separate Patta No.984 in respect of the land in Survey No.204/1, measuring an extent of 1.71 Acres and Survey No.205/6, measuring an extent of 2.33 Acres, totaling an extent of 4 Acres and 4 Cents, situated at Mothagam Village, Perayur Taluk, Madurai District, based on the petitioner's representation dated 24.12.2025, within the period that may be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself. Page No. 2 of 6

3. The case of the petitioner is that the subject properties were purchased by the petitioner from one Ramasamy on 24.08.2007. In respect of the said properties, a separate patta bearing Patta No.984 was granted in the name of the petitioner. However, it was later noticed that in respect of the same properties, a joint patta bearing Patta No.984 was issued in the names of six persons, out of whom two are the legal heirs of the petitioner's vendor, who had already executed a Release Deed dated 31.08.2007 in respect of the said properties and the remaining persons are unknown to the petitioner. Therefore, the petitioner submitted a detailed representation dated 24.12.2025 to the respondents seeking cancellation of the joint patta and restoration of the earlier separate patta issued in the name of the petitioner. Since the said representation did not evoke any response, the petitioner was constrained to file the present Writ Petition.

The learned Government Advocate appearing for the respondents would submit that there are rival claims over the properties; and that however, the petitioner's representation dated 24.12.2025 would be considered and appropriate orders would be passed by the Revenue Divisional Officer, the competent authority, within a period of twelve weeks.

Since the competent authority, namely, the Revenue Divisional Officer, Usilampatti Revenue Division, Madurai, has not been made a party to this Writ Petition, this Court suo motu impleads the Revenue Divisional Officer, Usilampatti Revenue Division, Madurai, as the third respondent and without expressing any opinion on the merits of the matter directs the third respondent to consider the petitioner's representation dated 24.12.2025 on its own merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.

6. The representation dated 24.12.2025 shall be considered and disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing during such enquiry to the petitioner and any other interested parties who may be affected by the decision. In view of the rival claims, the same shall be taken into consideration while disposing of the representation. If required, the parties are at liberty to pursue their remedies before the Civil Court. 7. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
