ORDER

(Order of the Court was made by G.R.SWAMINATHAN, J.) Heard both sides.

2. The petitioner is a resident of Keelatheru in Ilayangudi Taluk. According to him, the private respondents herein have encroached on a public street in S.No.296/7. It is not in dispute that S.No.296/7 has been classified as street.

3. According to the private respondents, this mistake crept in during UDR. The fifth respondent instead of applying to the District Revenue Officer had given a mere complaint before the RDO, Sivagangai.

4. However, taking note of the said facts of this case, we permit the respondents 5 & 6 to submit a formal petition before the jurisdictional DRO, Sivagangai District within a period of two weeks from the date of receipt of a copy of this order. If such an application is filed, the DRO shall dispose of the application on merits in accordance with law after notice to the petitioner within a period of three months thereafter. Based on the order to be passed by the DRO, consequential action shall be taken by the Tahsildar, Ilayangudi.

5. The Writ Petition is disposed of accordingly. No costs. (G.R.S., J.)
