PRAYER: This Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, to call for the records pertaining to the proceedings in Crime No.98 of 2015, on the file of the first respondent and quash the same.
For Petitioner : Mr.S.Paulmurugesh For Respondents : Mr.S.Prabha Government Advocate(Crl.Side) for R.1 COMMON ORDER Heard the learned Counsel for the petitioners, the learned Government Advocate(Crl.Side) appearing for the first respondent and the learned Counsel for the second respondent.
3. It is a case of case in counter for the alleged offences under Sections 147, 294(b), 323 and 506(ii) I.P.C.
4. When the matter is taken up for hearing, a joint memo of compromise has been filed by both parties in both cases and attested by the Counsel for both parties, in which it is stated that the parties have entered into a settlement out of Court and therefore, there is no necessity for proceeding further in this matter. The parties are also present.
5. This Court has also perused the nature of complaint and the joint memo of compromise filed in both cases. This Court is of the view that no useful purpose will be served by proceedings further in these matters.
6. Accordingly, both the Criminal Original Petitions are allowed and the proceedings in Cr.Nos.97 and 98 of 2015, on the file of the first respondent are quashed.
