Respondents PRAYER: This Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to issue a direction directing the Respondent No.1 to withdraw the case in Crime No.14 of 2019 pending before the Respondent No.2 and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation based on the petitioner's representation, dated 09.12.2019.

O R D E R

The Criminal Original Petition has been filed to issue a direction directing the Respondent No.1 to withdraw the case in Crime No.14 of 2019 pending before the Respondent No.2 and entrust the same to any other officer not below the rank of Deputy Superintendent of Police for investigation based on the petitioner's representation, dated 09.12.2019.

2. The learned counsel appearing for the petitioner would submit that the case was registered on 22.10.2019 and since no further steps have been taken the petitioner being dissatisfied with the investigation done had filed the present petition seeking to transfer the investigation.

3. Today, when the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents would submit that as per complaint, the case falls within the jurisdiction of All Women Police Station, Ponmalai and thereby, the second respondent is taking steps to transfer the case in Crime No. 14 of https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD).No. 533 of 2020 2019 to the file of the All Women Police Station, Ponmalai , Trichirapalli. She would further submit that direction may be issued to the Assistant Commissioner of Police, Ponmalai to monitor the investigation done by the Inspector of Police, All Women Police Station, Ponmalai, Trichirapalli.

4. In view of the aforesaid submissions, direction is issued to the second respondent to transfer the FIR in Crime No. 14 of 2019 to the file of the Inspector of Police, All Women Police Station, Ponmalai, Trichirapalli and the investigation shall be monitored by the Assistant Commissioner of Police, Ponmalai, Trichirappalli.

5. With the above directions, the Criminal Original Petition is disposed of.
