O R D E R
(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) Earlier the petitioner has filed a Writ Appeal in W.A(MD)No.1801 of 2023 against the impugned order dated 16.06.2023 passed in W.P(MD)No.12499 of 2020.
2.However, the learned counsel for the petitioner after arguing the matter for considerable length of time, had made a request for withdrawing the writ appeal by stating that the appellant will work out his remedy by filing a review petition. The Division Bench of this Court had not granted any relief to the petitioner to file the review application. Subsequently, the petitioner has also filed a review application and the said review application was dismissed by the learned Single Judge holding that an appeal was preferred and it was dismissed as withdrawn.
3.We find that in the earlier round of litigation in W.A(MD)No.1801 of 2023, the learned counsel for the petitioner had argued the appeal for considerable length of time and had made a request for withdrawal of the writ appeal and the
earlier Bench on 12.10.2023 has passed the following order: "The learned counsel appearing for the appellant, after arguing the matter for a considerable length of time, made a request for withdrawal of this Writ Appeal by stating that the appellant will workout his remedy by filing a review petition. 2.In view of the above statement, the appellant is permitted to withdraw this appeal. Accordingly, this Writ Appeal stands dismissed as withdrawn. No costs."
4. In the earlier round, the Division Bench has not granted leave to file the review application. The earlier writ appeal has been dismissed as withdrawn after hearing the counsel for considerable time. In view of the above, the Civil Miscellaneous Petition stands dismissed and consequently, the Writ Appeal is also rejected at SR stage.
