ORDER

This writ petition has been filed seeking Mandamus to direct the 1st respondent herein to defreeze the petitioner's Saving Account No. 248701000011147.

2. Heard the learned counsel on either side. Since this Court is directing to mark a lien to the tune of Rs.40,000/-, notice to the second respondent is dispensed with.

3. By consent, this writ petition is taken up for final disposal at the admission stage itself.

4. The first respondent has frozen the account of the petitioner based on the direction of the second respondent. However, total amount payable by the petitioner is only Rs.40,000/-. Therefore, it would suffice to create a lien on disputed amount of Rs.40,000/- and de-freeze the account. Therefore, this Court directs the first respondent to de-freeze the petition mentioned account, after marking a lien of Rs.40,000/-.

5. With the above direction, this Writ Petition is allowed. No costs.
