Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents herein to grant permission to the petitioner to remove the banyan tree in his patta land in survey No.1088/112 in patta No.19227 total extent 2.30 ares (2475 square feet which is situated at Adiyanuthu Village, Dindigul East Taluk, Dindigul, based on the petitioner's representation dated 12.12.2025 within a stipulated period as prescribed by this Court. O R D E R

This Writ Petition has been filed seeking a direction to the respondents to grant permission to the petitioner to remove a banyan tree standing in his patta land comprised in Survey No.1088/112, Patta No.19227, to an extent of 2.30 ares (2475 sq.ft.), situated at Adiyanuthu Village, Dindigul East Taluk, Dindigul District, by considering the petitioner's representation dated 12.12.2025, within a time frame to be stipulated by this Court.

2. It is the case of the petitioner that he intends to remove a banyan tree standing in his subject property and, therefore, submitted a representation before the respondents on 12.12.2025. It is further stated that subsequently, the first respondent has sent a communication to the fourth respondent on 23.12.2025 for taking necessary follow-up action. However, the fourth respondent has not taken any further steps, which constrained the petitioner to file the present Writ Petition.

3. The learned Additional Government Pleader appearing for respondents 1 and 3 to 6 would submit that the petitioner's request will be considered in accordance with law.

4. In view of the above submission and without expressing any opinion on the merits of the matter, this Court directs the fourth respondent to take necessary action on the petitioner's request, taking into account the communication sent by the first respondent dated 23.12.2025, and pass appropriate orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
