JUDGMENT

(Judgment of the Court was delivered by R.SURESH KUMAR, J.) This Writ Appeal has been directed against the order passed by the Writ Court dated 07.10.2013 made in W.P.(MD)No.6433 of 2013, wherein the transfer order passed against the appellant/writ petitioner was under challenge.

2. A learned Judge, who heard the matter, by order dated 07.10.2013, rejected the said Writ Petition, as against which, the present Writ Appeal has been filed.

3. Today, when the appeal is taken up for hearing, Mr.C.Karthick, learned counsel appearing for the appellant would submit that since the very issue arise in the Writ Petition itself is the transfer order of the year 2013, therefore, after 10 years nothing would survive to agitate the issue with regard to the said transfer order, therefore, he would submit that, the Writ Appeal, accordingly can be disposed of.

4. Recording the aforestated, as the issue itself is non est as on today, since it has become infructuous, the Writ Appeal is dismissed. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
