ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the fourth respondent to resurvey the land and properly demarcate the same by fixing boundary stones in respect of Survey No.260/1A1A, measuring 81.50 Ares situated at Thirupalaikudi Village, Rajasingamangalam Taluk, Ramanathapuram District and consequently, direct the fifth respondent to provide adequate police 2/6
protection for fixing boundary stones, by considering the petitioner's representation dated 02.01.2026.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the property in question belongs to the Wakf Board and the petitioner is the president of North Muslim Jamath Sabai, Thirupalaikudi. The petitioner has made an application for the survey of the property and for demarcation of its boundaries. However, the fourth respondent surveyed the property, but failed to fix the boundary stones. When the petitioner went to the property to lay the boundary stones and fence it, he was restricted by a third party from doing so. Hence, the petitioner submitted a representation dated 02.01.2026, seeking resurvey of the land and proper demarcation by fixing the boundary stones of the said property. However, no action has been taken on the said representation to date. Hence, the present Writ Petition.

The learned Government Advocate appearing for the respondents 1 to 4 would submit that after consideration of the claims of the parties, proper steps would be taken to survey and demarcate the land in question in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

Recording the aforesaid submissions, this Court directs the respondents 3 and 4 to consider the representation of the petitioner dated 02.01.2026, for resurvey and proper demarcation of the petitioner's land, after considering the claims of all parties and pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of sixteenth weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that before surveying the land, notice shall be issued to the adjacent landowners and other interested parties, if any and that if required, police assistance may be taken.

6. With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
