ORDER : The Court Made the following order :- The petitioners, who are arrayed as A-1 and A-2 in Crime No.26 of 2015 on the file of the respondent police for the offences under Sections 406, 420 and 120(b) I.P.C apprehend arrest at the hands of the respondent police and hence, seeks anticipatory bail.
2. The petitioners are husband and wife. A-3 is the son and he was arrested by the respondent police. The allegation against the first petitioner is that he has acted as Secretary to the Honourable Chief Minister and collected money by assuring to get job. The allegation against the second petitioner is that she has acted in collusion with the first petitioner. 3.Insofar as the first petitioner is concerned, there is a specific allegation that he has collected money with a false promise to get jobs by acting as Secretary to the Honourable Chief Minister. Hence, I am not inclined to grant anticipatory bail to the first petitioner. Therefore, this Criminal Original Petition is dismissed in respect of the first petitioner.
4.Insofar as the second petitioner is concerned, there is no sufficient material at this stage to implicate her except the fact that she is the wife of the first petitioner.
5. Considering the same, this Court is inclined to grant anticipatory bail to the second petitioner, with certain conditions. Accordingly, the second petitioner is ordered to be released on bail https://hcservices.ecourts.gov.in/hcservices/
in the event of arrest or on her appearance before the learned Judicial Magistrate, Theni and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the second petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The second petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The second petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
