JUDGMENT

(Judgment of the Court was delivered by DR.ANITA SUMANTH , J.) This Writ Appeal has been filed by the State challenging the order passed on 04.02.2011 by Writ Court in W.P(MD)No.1064 of 2008. 2.Pending Writ Appeal, the respondent is stated to have passed away. However, neither the learned Government Advocate or the learned Counsel for the respondent are able to proceed further in the matter, as the details of legal heirs are unavailable.

3.The learned Counsel for the respondent has also filed a memo to the effect that a communication addressed to the respondent has been returned as 'deceased' and they are unable to procure any other information in this regard.

4.Seeing as the Writ Appeal is of the year 2013, we see nothing to be gained in keeping the matter pending on the docket of this Court. Hence, this Writ Appeal is closed. Liberty is granted to the appellant to revive the matter if they are in a position to procure details of the legal 2/4

heirs, for upto one month from date of receipt of a copy of this judgment. No costs. Consequently, connected miscellaneous petition is closed. [A.S.M.J.,] & [R.V.J.,] 18.07.2023 NCC :Yes/No Index :Yes/No Internet :Yes cmr 3/4
