ORDER
This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 3 and 4 to issue separate patta in petitioner's favour in respect of the properties in Survey Nos.197/9C1 and 197/6C1 measuring to an extent of 2 cents and 5 cents, respectively, situated at Koopilikadu East Street, No.30 Peravurani - 2nd Bit, Peravurani Taluk, Thanjavur District, in the light of the fourth respondent's report dated 23.12.2021 in Na.Ka.3871/2020/E2 in accordance with law, within the time frame to be stipulated by this Court.
2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel appearing for the petitioner would submit that the petitioner is the absolute owner and is in peaceful possession and enjoyment of the subject properties. The petitioner had earlier submitted an application dated 01.07.2016 before the fourth respondent; however, the same was rejected. Thereafter, the petitioner preferred a petition before the third respondent. Subsequently, the fourth respondent submitted a report dated 23.12.2021 recommending issuance of patta to the petitioner. Thereafter, no action has been taken. Hence, the present Writ Petition.
4. The learned Special Government Pleader appearing for the respondents would submit that the petitioner's request will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 3 and 4 to consider the request of the petitioner for separate Patta, and pass appropriate orders on merits and in accordance with law after providing
reasonable opportunity of hearing to the petitioner, and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order.
