JUDGMENT

This second appeal has been filed to set aside the judgment and decree of the learned District Judge, Kanniyakumari at Nagercoil dated 15.11.2005 passed in A.S.No.180 of 2003 which confirm the order passed in O.S.No.123 of 2002 on the file of the Sub Ordinate Judge, Padmanabhapuram.

2. When the matter was taken up for hearing, the learned counsel appearing for the appellant submitted that the sole appellant died on 03.09.1990 and steps have not been taken within the period of limitation as stipulated.

3. In view of the above, this second appeal is dismissed as abated. No costs.
