PRAYER IN AS(MD) No.SR16604 of 2016:- to prefer this Memorandum of Appeal against the judgment and decree dated 27.11.2015 passed in I.A.O.P.No.301 of 1996 on the file of the Additional Subordinate Judge, Thanjavur ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.M.P.SENTHIL, Advocate for the petitioners and of Mr.AAYIRAM K.SELVAKUMAR, Additional Government Pleader for R1, Mr.K.GUHAN, Advocate for R2 to R5, R6 to R11 not appeared either in person or by an Advocate,the court made the following order:-

This petition is filed to condone the delay of 309 days in paying the deficit court fee of Rs.27,275/- in the Appeal Suit.

2. Heard the learned counsel appearing for the petitioners as well as the learned counsel for the respondent.

3. This Court is satisfied with the reasons stated in the affidavit filed in support of the petition to condone the delay of 309 days in paying the deficit court fee of Rs.27,275/- in the Appeal Suit. Since the delay is inordinate, the delay is condoned on condition that the petitioner pays Rs.1000/- (Rupees Thousand only) to the Hon'ble Chief Justice relief fund within a period of two weeks from today.

4. Registry is directed to number the appeal suit, if the papers are otherwise in order.
