Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the second respondent to cancel the quarry licence issued to the sixth respondent in Sy. Nos.339/6, 339/7, 340/1(P), 340/4A1 and 340/4D, Nedungulam Village, Sathankulam Taluk and Thoothukudi District, within the time stipulated by this Court by considering the petitioner's representation dated 08.10.2025.

O R D E R

This writ petition has been filed seeking a direction to the second respondent to cancel the quarry licence issued to the sixth respondent in Sy. Nos.339/6, 339/7, 340/1(P), 340/4A1 and 340/4D, Nedungulam Village, Sathankulam Taluk and Thoothukudi District, within the time stipulated by this Court, by considering the petitioner's representation dated 08.10.2025.

2. It is the case of the petitioner that he is the absolute owner of the property comprised in Re-Survey Nos.339/1 and 339/2, Nedungulam Village, Sathankulam Taluk, Thoothukudi District. The petitioner's 2/5

agricultural lands are situated within 90 metres of a newly commenced stone quarry belonging to the sixth respondent, located in Survey Nos. 339/6, 339/7, 340/1 (p), 340/4A1 and 340/4D, Nedungulam Village, Sathankulam Taluk, Thoothukudi District. The grievance of the petitioner is that, due to the stone-breaking activities carried on in the said quarry, stone fragments are frequently scattered into the petitioner's agricultural lands, thereby causing damage to the roofing of his pumpset. Hence, the petitioner made a representation to the respondent on 08.10.2025 seeking cancellation of the quarry licence issued to the sixth respondent. However, the said representation has not been considered till date. Therefore, the present writ petition has been filed.

3. The learned Additional Government Pleader appearing for the respondent Nos.1 to 5 would submit that the representation of the petitioner dated 08.10.2025 would be considered in accordance with law.

In view of the above, without expressing any opinion on the merits of the matter, this Court directs the second respondent to consider the representation of the petitioner dated 08.10.2025 and pass appropriate orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order. 3/5

5. With the above direction, the writ petition stands disposed of. No costs.
