ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.M.GANESHKAMU, Advocate for MR.V.PANDI, Advocate for the petitioner and of MR.N.MOHIDEEN BASHA, Standing Counsel on behalf of the Respondent, the court made the following order:- The Petitioner, who is convicted by the Hon'ble Madurai Bench of Madras High Court in Suo Motu Contempt Petition(MD) No.1124 of 2022 and released on bail in pursuance of the orders of the Hon'ble Apex Court in Criminal Appeal No(s).1845 of 2022, now seeks to completely relax the condition imposed in Sub.A(MD)No.164 of 2022 in Suo Motu Contempt Petition(MD) No.1124 of 2022, vide order dated 16.12.2022.

Sub Application(MD) No.23 of 2023 Chief Metropolitan Magistrate, Chennai, has reported that the petitioner is complying the conditions regularly till date from 24.01.2023.
The Petitioner seeks to relax the condition imposed by this court in pursuance of the directions of the Hon'ble Supreme Court. The Petitioner expresses his difficulty in appearing before the Court regularly by citing his health condition and also over about the difficulty in workingout his livelihood. At the same time, he also claims that there is no necessity for appearance before the Court as there is no investigation pending in the Court. Though, there is no investigation pending in the case, condition is imposed on the petitioner for monitoring his conduct for co-operation with the Court for trial and he has also complied the conditions regularly. Having considered the compliance of the conditions by the petitioner so far and also upon considering his conduct till date, this Court is inclined to relax the condition to the extent that the Petitioner shall appear before the same Court on the first working day of every month at 10.30 am until further orders.
