ORDER

This Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 praying to direct the second respondent to secure the accused persons in Crime No.113 of 2015 on the file of the second respondent.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

3. Seeking to secure the accused in Crime No.113 of 2015 on the file of the second respondent, the petitioner, who is the defacto complainant, has filed this Criminal Original Petition.

4. A status report has been filed stating that the petitioner's son has met with an accident, as not alleged by the petitioner.

5. The learned counsel appearing for the petitioner submitted that none of the persons mentioned in the complaint have been enquired. On the other hand, some other irrelevant persons have been enquired and complaint is sought to be closed. He has also further submitted that the proposed accused obtained anticipatory bail. However, they have not even complied with the conditions.

6. Considering the submissions made, this Court is inclined to transfer the investigation from the file of the respondent No.2. https://hcservices.ecourts.gov.in/hcservices/

7. Accordingly, a direction is issued to the respondent No.1 to transfer the investigation from the file of the respondent No.2 to any other officer.

8. With the above directions, this Criminal Original Petition is disposed of.
